dollars for a stock photo when you can get it here for about $1.99? YOAQ.com offers a fine image
bank of free and affordable photos and videos (so-called "royalty-free" images) perfect for
designers, photography fans, mediums, websites or prints.
You must be at least 18
years of age to use the Website and accept this Agreement.
You acknowledge that the content available through the website is the property of YOAQ or its
content providers or other third parties and is protected by copyright and possibly other
intellectual property laws. Furthermore, you acknowledge that trademarks and copyrights of the
subject matter depicted in the images are subject to protection by intellectual property laws
and that you must obtain consent from the owners of the intellectual property whenever necessary
to comply with intellectual property laws.
YOAQ licenses to you the use of image files (photos and videos etc.) only as provided below on a
nonexclusive and nontransferable basis upon payment of the required fees. All other rights to
the image files and any accompanying materials such as copyright are retained by YOAQ and its
members. The license is limited to one usage per download. For example, if an image is used in a
website design and in a greeting card design, this is considered two usages for which the image
license should be purchased two times. You
expressly agree that use of all images, files, or software distributed by YOAQ is at your sole
risk.Basic License: You may print or use the image for your personal
use in any size provided that there is no subsequent sale or transfer to other persons. The
high-resolution images that you download under the Basic License may be used to make fine art
prints, on web sites, in magazines, newspaper, products, software, newsletters, advertisements,
flyers, packaging, marketing material, school assignments, presentations, and within films or
videos, books or booklets, in either printed or electronic media, as long as the item in which
the image appears does not contradict any of the restrictions below. Note that the maximum
number of copies for printed materials is 10,000 copies. The high-resolution images that you download with the
Basic License also may be used as "editorial use" to illustrate truthful articles or broadcasts appearing in magazines, newspapers or any other editorial context, in either printed or electronic media.
Note, depending on your use, the use of editorial use images may require additional rights that
YOAQ may not be able to provide. Without a YOAQ Extended License, you may not
use our images in products in which these images are dominant feature if the product is to be
subsequently sold or distributed. Examples include posters, postcards, greeting cards, mugs,
T-shirts, canvas, hats, mouse pads, magnets, art prints, paintings, or calendars, and
screensavers, web templates, software, web page builders, gallery, or any system where the image
file can be unincorporated from the software or system or be shared among, transferred to, or
otherwise distributed to a number of users. It is also forbidden to make the image available on
a website for download (as wallpapers for example). The use of YOAQ.com images for these
purposes under the Basic License is not permitted. In these cases, you should buy Extended
Licenses.
Extended Licenses: The following licenses offer extended types of usage for our Basic Licenses.
These are additional licenses to the rights included within the Basic Licenses. Note that the other restrictions still apply.
1.
Increase Max Copies: Extends our Basic Licenses to a maximum amount of printed copies of up to
1,000,000 copies.
2. Electronic Items for Resale: this license includes the right to use the images for web templates that are sold to more customers, screensavers, e-cards, powerpoint
presentations or as wallpapers on cell phones. Maximum number of electronic items is 10,000 copies
(applies as a total of each type of usage). If this amount is exceeded you need to acquire this
license once again. The new license will provide you with the standard amount of copies.
3. Physical Items for Resale: includes the right to use the photos for T-shirts, postcards, greeting
cards, mugs, mouse pads, posters, calendars, framed artwork that is to be sold to other customers
for a maximum amount of 10,000 copies (applies as a total of each type of usage). If this amount is
exceeded you need to acquire this license once again. The new license will provide you with the
standard amount of copies.
Buying the high-resolution image (purchasing the license) does not transfer the copyright. You may not claim that the image is your own and you may not sell, license for use, or in any way distribute the image for reuse.
Unauthorized Use:
Images may not be used as a trademark or service mark, in any way that violates civil and
criminal laws such as those regulating pornography, obscenity, fraudulent schemes,
counterfeiting, espionage, and aid to illicit activities, to defame a person, to violate a person's right to privacy or publicity, to infringe upon any copyright, trade name, trademark, or service mark of any person/entity. Unauthorized use of these Images constitutes copyright infringement and shall entitle YOAQ to exercise all rights and remedies under applicable copyright law, including an injunction preventing further use and monetary damages against all users and beneficiaries of the use of such Images. The foregoing is not a limiting statement of YOAQ's rights or remedies in connection with any unauthorized use. All purchases are non-refundable.
DISCLAIMER: YOAQ PROVIDES YOU WITH ITS SITE, IMAGES, AND FILES ON AN "AS IS" AND "AS
AVAILABLE" BASIS. WE OFFER NO WARRANTY, EXPLICIT OR IMPLIED, REGARDING ANY IMAGES, THE SITE, THE

LIABLE TO YOU OR ANY OTHER THIRD PARTY CLAIMING THROUGH IT FOR DIRECT, INDIRECT, INCIDENTAL,
SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF, OR RELATING TO THE USE OF THE IMAGES, WHETHER
FRAMED AS A BREACH OF WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR
NON-INFRINGEMENT, UPON ANY LEGAL THEORY, IN TORT, CONTRACT, FAILURE OF ESSENTIAL PURPOSE, OR
OTHERWISE. IN NO EVENT SHALL YOAQ'S OR ITS AFFILIATES' LIABILITY FOR YOUR USE OF ANY IMAGE
PROVIDED HEREUNDER EXCEED THE GREATER OF THE AMOUNT INVOICED AND PAID BY YOU FOR THE USE OF THAT
IMAGE. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY
